Judge's Order on Birth Certificates Defied by Health Department

A Montana judge prevented health officials from executing a state law that would restrict transgender people from changing the gender on their birth certificate.

The state declared that it would disobey the ruling on Thursday.

The verdict is the result of a lengthy legal dispute between the state and the judge that started in 2021.

The state approved a law requiring "surgical procedure" before changing the sex recorded on a person's birth certificate.

District Court Judge Michael Moses ordered an interim injunction preventing the implementation of such statute in April 2022.
